Terms of Service
These Terms of Service ("Terms") govern your access to and use of the GapX indicator and the gapx.app website (collectively, the "Service"). By purchasing or using GapX, you agree to these Terms.
1. The Service
GapX is a technical analysis indicator written in Pine Script and delivered as an invite-only script on TradingView. It provides decision-support information about market opening gaps. GapX does not provide financial, investment, trading, or tax advice.
2. License
Upon successful payment, GapX grants you a limited, non-exclusive, non-transferable, revocable license to use the indicator within a single TradingView account, solely for personal trading use.
You may not:
- Share, resell, sublicense, lease, or distribute the indicator or any portion of its source code
- Reverse-engineer, decompile, or attempt to extract the protected logic
- Use the indicator on accounts other than the one provided at checkout
- Use GapX in any automated bot or service offered to third parties without prior written consent
3. Payment & Subscription
Payments are processed by Whop. By purchasing GapX you authorize the charge specified at checkout (one-time for Lifetime, recurring monthly for Monthly). Monthly subscriptions auto-renew until cancelled. You may cancel at any time from your Whop account dashboard or by emailing support@gapx.app.
4. Refunds
Refunds are handled directly through Whop after purchase. To request one, email support@gapx.app with your order details and we'll work with you on it.
5. Updates & Availability
We aim to deliver regular updates and bug fixes. Monthly subscribers receive updates while their subscription is active. Lifetime customers receive updates for the life of the product. We do not guarantee uninterrupted access; TradingView is an independent platform and changes to it may affect functionality.
6. No Investment Advice
GapX is a tool — not advice. Historical statistics shown on the site (including gap-fill rates) are descriptive, not predictive. Trading involves risk, including possible loss of principal. You alone are responsible for your trading decisions, position sizing, and risk management.
7. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be error-free or that signals will be accurate.
8. Limitation of Liability
To the maximum extent permitted by law, in no event shall GapX, its operators, or its affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, or trading losses, arising out of or in connection with your use of the Service. Our total aggregate liability for any claim shall not exceed the amount you paid for the Service in the twelve months preceding the claim.
9. Termination
We may suspend or terminate your access to the Service if you breach these Terms (including sharing the indicator). On termination, your license ends and you must stop using the indicator.
10. Changes
We may update these Terms from time to time. Material changes will be communicated by email or via the website. Continued use after changes constitutes acceptance.
11. Governing Law
These Terms are governed by the laws of [Your Jurisdiction], without regard to conflict-of-law principles.
